Utilise Kia Connect as substantiating proof

Greetings

We have recently been issued a speeding citation (travelling at a speed of 83mph on a motorway), which we believe to be unjustified.

I was occupying the front seat as a passenger while my boyfriend was driving. The vehicle consistently maintains a speed of 70mph while using adaptive cruise control on the highway. I have successfully retrieved and captured a snapshot of the driving history from the Kia Connect app, providing concrete evidence to support my claim.

Has anybody successfully contested a citation by using Kia Connect as supporting evidence? One possible alternative is to enrol in a speed awareness course, which would result in the offence being dismissed. However, this choice may evoke a strong sense of moral discomfort. However, it might be described as a scenario when there is a clear division between two opposing groups.

I am not a lawyer. However, I believe it would be challenging for you to override the Kia Connect data in order to replace a camera picture from a properly functioning and calibrated speed camera. Attempting to do so would require forfeiting the Speed Awareness option, which would not be available to you in the future if you were unsuccessful in your attempt. You may also be required to bear the cost of hiring expert witnesses to substantiate your claim.

I concur. I hypothesise that the ACC (Adaptive Cruise Control) maintains a speed range of 69 to 71, but may sometimes be affected by sudden changes in the road surface, such as dips. However, a difference of 1 mile per hour compared to a speed of 70 miles per hour is likely to fall within the range of acceptable tolerance.

It is unfortunate that you do not own any dash camera video that includes GPS speed data. I understand that discussing this after the fact is purely speculative and does not provide any assistance in your current predicament. However, it is a scenario where it may have potentially shown your innocence.

I am optimistic that the evidence you possess will be examined in a positive light, while I am concerned that it may not be the outcome.

Request to see the photographic proof. A friend of mine was caught for driving at a speed of 38 mph in a 30 mph zone. Despite his belief that he was not speeding, he requested to see the proof. He obtained two photographs that depicted the distance travelled and the corresponding speed required to cover that distance. Based on the measures he calculated, he determined that he was travelling at a speed of 27 mph, and he questioned the validity of the proof. After being reviewed by a human, they concurred and dismissed the allegation. It is always beneficial to inquire.

Have they provided you with photographic proof of your car, including its registration number, being recorded exceeding the speed limit? Alternatively, have you received a Section 172 (2) RTA 1988 notice as the registered owner, asking for the identity and address of the driver?

If you get a notice on the 172, it is imperative that you respond within 28 days to avoid incurring an additional offence.

By the way, if you want to attend a speed awareness course, you are still required to inform your insurance carrier. If you fail to fulfil the requirements and then file a claim, there is a possibility that they may refuse it and terminate the policy.

Valid observation 👍. Upon reviewing an outdated renewal notification, I have seen that it requests information about convictions or pending prosecutions. Therefore, it may be inferred that a speed awareness course serves as a means of resolving a pending speeding charge without the need for a court appearance.

"It is unnecessary to inform LV that you will be participating in a speed awareness course, or that you have already completed one." Please provide information on any points on your driving licence resulting from a traffic conviction or fixed penalty notice.It is advisable to discreetly examine the policy of your insurance provider.

What was the method of recording used? Is the camera mounted on a gantry or is it a portable gun?

The only feasible method I can think of to use Kia data is by manually operating the gadget and challenging its calibration. (If that is still a current practice) However, pursuing legal action would include appearing in court, where a conviction might result in a more substantial monetary penalty and accumulation of demerit points.

Seeking legal counsel might be advisable, since they can assess your financial capacity. Considering the potential expenses associated with counsel.
